Beta Terms of Use

1. About Promptivity

Promptivity is an independently developed and privately operated beta project created by Mikkel Munksgaard-Street in Denmark. For this pilot it is non-commercial and provided free of charge for testing, learning and evaluation.

Promptivity is independent. Unless explicitly stated otherwise, it is not created, operated, sponsored or endorsed by the creator's employer or any other organisation. It is an experimental product under active development, not a paid service or service-level offering.

2. Invitation access and pilot window

Access to the beta is by invitation. The current pilot is scheduled to run from 5 October through 16 October 2026, inclusive. Access is temporary and does not create a right to continued use before, during or after that period.

The access code is intended for invited participants. Do not publish, sell or deliberately distribute the access code outside the invited pilot group.

5. Your responsibility

You are responsible for the information you submit, for ensuring you have the rights and permissions required to use it, and for checking whether your employer, client or organisation permits that information to be processed through external AI services.

You remain responsible for every decision, communication and action you take after using Promptivity, including consequences for you, your organisation or third parties.

6. Submitted content and generated output

You keep any rights you already hold in content you submit. You give Promptivity the limited permission necessary to transmit, process and use that content to operate the beta and produce the output you request. You must have the rights and permissions needed to do so.

Generated output may not be unique, and similar output may be produced for other users. Any rights in generated output are subject to applicable law and relevant third-party service terms. You remain responsible for reviewing material before you rely on, send or publish it.

7. AI-generated output

Promptivity provides AI-assisted decision support and drafting assistance. Outputs may be inaccurate, incomplete, outdated, misleading, biased or inappropriate for the circumstances. No output is a definitive statement of fact, a promise or a guarantee of outcome.

Review outputs before using them, verify material facts and apply your own professional judgment. Promptivity should support judgment, not replace it.

8. No professional advice

Promptivity does not provide legal, financial, tax, medical, regulatory, employment, HR, compliance or other regulated professional advice. It should not be used as the sole basis for decisions that materially affect another person's rights, employment, finances, health, legal position or other significant interests.

9. Third-party services

Promptivity relies on third-party infrastructure and AI services, including OpenAI, Vercel and Supabase. Availability, processing, security and retention can therefore depend on those providers and on Promptivity's configuration. Relevant data handling is described in the Privacy Notice.

10. Local history and data preservation

The no-account experience can keep My Promptivity situation history locally in the browser on the device you use. Local history is not a cloud backup and is not guaranteed to persist. Clearing browser data, changing browser or device, private-browsing behaviour, browser policies or storage limits can remove it.

Keep your own copy of anything you need. Promptivity does not provide a data-preservation or recovery commitment for the beta.

11. Fair use, capacity and availability

The pilot operates within predefined usage controls and a fixed AI processing budget, including token consumption. The current free beta provides two free completed situations per day per viewer, alongside refinement, provider and technical limits. These limits may be tightened if needed for the pilot budget or service stability. Do not bypass those controls, automate high-volume use or use the beta in a way that creates disproportionate load, security risk or cost.

If the allocated pilot budget is exhausted or forecast to be exceeded, or if a provider limit, technical constraint, security issue, safety threshold or operational issue is reached, Promptivity may restrict, pause or discontinue new generations before 16 October 2026.

There is no obligation to purchase additional capacity, restore access, extend the pilot or provide a minimum number of uses.

12. No service level, warranties and liability

Promptivity is provided on an "as is" and "as available" basis. No uptime, response-time, continuity, data-preservation or minimum-use commitment is being purchased or promised. Do not rely on the beta as business-critical infrastructure.

To the fullest extent permitted by applicable law, no representation or warranty is made regarding accuracy, completeness, reliability, availability, security, non-infringement, fitness for a particular purpose or any particular outcome.

To the fullest extent permitted by applicable law, Promptivity and its creator are not liable for indirect or consequential loss, loss of profit, opportunity, business, reputation or data arising from reliance on AI-generated output, user decisions or actions, service interruption, suspension or discontinuation, exhaustion of the pilot budget or third-party provider failure. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

13. Suspension, termination and changes

Access may be restricted, suspended or terminated where reasonably considered necessary for budget control, security, misuse prevention, legal or compliance reasons, technical stability, provider availability or pilot management. Advance notice is not guaranteed.

Because this is a limited beta, features, limits and functionality may change. Material changes to these Terms during the pilot should be communicated through the product or pilot channel before they apply to continued use.

14. Governing law and severability

These Terms are governed by Danish law, subject to mandatory rights, rules and jurisdiction requirements that cannot lawfully be excluded or limited. If a provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
